Privacy Notice on the Protection of Personal Data

This notice has been prepared by NKA Mimarlık – Nihat Karabay ("NKA Mimarlık") as data controller, pursuant to Article 10 of the Turkish Personal Data Protection Law No. 6698 ("KVKK"), to inform you about how the personal data you share with us through the nkamimarlik.com.tr website and our other communication channels is processed.

2. Personal data processed

• Identity data: first name and surname.
• Contact data: phone number and email address.
• Request data: appointment date and time, meeting type, the service you are interested in, the type, location, approximate area and stage of your project, and any other information you share with us in your message.
• CV data: the education and experience details, software skills, CV and portfolio files and cover letter you share when applying for a job.
• Transaction security data: technical records such as IP addresses kept by our hosting provider to keep the website running securely.

Please do not share special categories of personal data, such as health, religion or ethnic origin, in forms or messages.

3. Purposes of processing

• to receive and evaluate your appointment and quote requests and respond to you,
• to evaluate job applications as part of the recruitment process,
• to plan meetings, prepare quotes and carry out pre-contract procedures,
• to provide our services and stay in touch with you,
• to fulfil our legal obligations,
• to keep our website secure.

4. Legal grounds

Your personal data is processed on the legal grounds set out in Article 5(2) of the KVKK: it is directly related to the conclusion or performance of a contract (item c), it is necessary for the data controller to fulfil its legal obligations (item ç), and it is necessary for the legitimate interests of the data controller, provided that it does not harm your fundamental rights and freedoms (item f).

5. How personal data is collected

Your personal data is collected partly by automated and partly by non-automated means, through the appointment and quote forms on our website, email, phone, WhatsApp and social media messages, and face-to-face meetings.

6. Transfer of personal data

Limited to the purposes above, your personal data may be transferred, in accordance with Article 9 of the KVKK, to the service providers we use for website hosting, form delivery and email (such as Cloudflare, Web3Forms and Google), whose servers may also be located abroad. It may also be shared with legally authorised public authorities upon their request and within legal limits. Your personal data is never shared with third parties for marketing purposes.

7. Retention period

Your personal data is kept for as long as the purpose of processing requires and for the retention and limitation periods set out in the relevant legislation. CVs and portfolios shared with a job application are kept for up to two years. After these periods end, it is deleted, destroyed or anonymised.

8. Your rights under the KVKK

Under Article 11 of the KVKK, you have the right to learn whether your personal data is processed; to request information about it if so; to learn the purpose of processing and whether it is used accordingly; to know the third parties in Türkiye or abroad to whom it is transferred; to request correction if it is incomplete or inaccurate; to request its deletion or destruction under the conditions of Article 7 of the KVKK; to request that these actions be notified to the third parties it was transferred to; to object to any outcome against you resulting solely from automated analysis; and to claim compensation if you suffer damage due to unlawful processing.

9. Applications

You can send requests concerning your rights, in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller, in writing to our address above or by email to info@nkamimarlik.com.tr . Your application will be concluded free of charge as soon as possible and within thirty days at the latest, depending on its nature.
